These Terms of Service (“Terms”) govern access to and use of Vastraa Verse (“Platform”), operated by Brasia Fabricsist Private Limited (“Company”, “We”, “Us”, “Our”). By accessing, browsing, or making a purchase on this Platform, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, you must not use the Platform.

The Company shall not be liable for losses arising from unauthorized account access due to user negligence.

4. PRICING & PAYMENTS

  • All prices are displayed in Indian Rupees (INR) unless stated otherwise
  • Prices are inclusive or exclusive of taxes as specified at checkout
  • Payments are processed through secure third-party payment gateways
  • The Company does not store card details, UPI PINs, or banking credentials

Orders may be cancelled or refused in cases of pricing errors, suspected fraud, or regulatory restrictions.

Shipping and delivery of physical products are governed by the Shipping & Delivery Policy, which forms an integral part of these Terms.

Delivery timelines are indicative and may vary due to logistical or external factors beyond the Company’s control.

6. REFUNDS, RETURNS & CANCELLATIONS

Refunds and cancellations are governed by the Refund & Cancellation Policy, which is incorporated into these Terms by reference.

By placing an order, you acknowledge and agree to the refund eligibility conditions stated therein.

7. DIGITAL PRODUCTS & LICENSE

For digital products, where applicable:

  • Access is granted for personal, non-commercial use only
  • Redistribution, resale, reproduction, or modification is strictly prohibited
  • All sales are final unless expressly stated otherwise

Violation may result in account termination and legal action.

8. INTELLECTUAL PROPERTY RIGHTS

All content on Vastraa Verse, including but not limited to:

  • Logos, designs, graphics, images
  • Text, layout, product descriptions
  • Software and platform architecture

are the exclusive intellectual property of Roughvesture Private Limited and are protected under applicable Indian laws.

Unauthorized use, copying, or exploitation is strictly prohibited.

9. USER CONDUCT

You agree not to:

  • Use the Platform for unlawful or fraudulent activities
  • Upload or transmit malicious code or harmful content
  • Violate intellectual property or privacy rights of others
  • Interfere with Platform security or operations

The Company reserves the right to suspend or terminate access without notice for violations.

10. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  • The Company shall not be liable for indirect, incidental, or consequential damages
  • Liability shall not exceed the amount paid by the user for the specific product or service giving rise to the claim

11. INDEMNIFICATION

You agree to indemnify and hold harmless Roughvesture Private Limited, its directors, officers, employees, and partners from any claims, losses, damages, or expenses arising from:

  • Violation of applicable laws or third-party rights

12. PRIVACY & DATA PROTECTION

Use of the Platform is also governed by the Privacy Policy, which outlines how personal data is collected, stored, and protected in compliance with Indian data protection laws.

13. FORCE MAJEURE

The Company shall not be liable for failure or delay in performance caused by events beyond its reasonable control, including natural disasters, government actions, network failures, or logistics disruptions.

14. GOVERNING LAW & JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of India.

Courts located in Kolkata, West Bengal shall have exclusive jurisdiction over all disputes arising under these Terms.

15. MODIFICATIONS TO TERMS

The Company reserves the right to revise these Terms at any time. Continued use of the Platform after updates constitutes acceptance of the revised Terms.
